What has this accident shown us?

We want to discuss an accident that happened in March 2018 that took the life of an Apple engineer. The 38-year-old was driving his 2017 Tesla Model x P100D when the vehicle struck a non-operational SCI SmartCushion 100GM crash attenuator on US Highway 101. 

The National Transportation Safety Board says that “The attenuator, a device intended to protect motorists by reducing collision forces, was not operational, having been damaged due to March 12, 2018, crash – 11 days before the fatal Tesla crash.”

The driver of the Tesla died of blunt force trauma injuries he suffered in the crash. The NTSB, as a result of their ongoing investigation, has issued a safety recommendation that urges California transportation officials to move faster to repair their highway safety barriers that have been damaged by vehicles. They say that their review of Caltrans maintenance records identified several examples of delayed repairs of the crash attenuator at the specific location of this crash. 

Could this be wrongful death?
