SAN FRANCISCO EMPLOYMENT LAW
In California, non-exempt employees must be paid for all the overtime they have worked. This law is governed by the California Labor Code and the Wage Orders of the Industrial Welfare Commission. If your employer is not properly paying you for all time worked, they are in violation of California Law.
You must be paid daily overtime at time and one-half times the rate of pay when you work in excess of eight hours in a day and weekly overtime at time and one-half when you work in over forty (40) hours in a work week.
There are many other violations that employers commit, including not permitting you to have the rest periods that you are entitled to under California Law. The law insists that each employer must provide an uninterrupted meal period of at least thirty minutes for any time worked in excess of five hours. This means that you must not be required to during your rest period. If you are required to do so, this is in violation of California Law and you are entitled to compensation.
